Can I Name My Baby if I’m Placing Them for Adoption?

If you're considering adoption for your baby, you’re likely experiencing a mix of emotions—love, uncertainty, and an overwhelming desire to make the best decisions for your child. One common question we hear at Gaudin Law Group is:
“Do I still get to name my baby if I choose adoption?”
The answer is yes —in Louisiana, birth parents do have the right to name their baby, even if they plan to place the child for adoption.

Naming Rights for Birth Parents

As the biological mother (and in some cases, the biological father), you have the legal right to choose your baby’s name at birth. This includes:

  • First, middle, and last name

  • Name on the birth certificate

  • Choosing a name that holds personal, cultural, or spiritual significance

You can provide this information at the hospital or birthing center when completing the original birth certificate.

What Happens to the Baby’s Name After Adoption?

The name you give your baby at birth will appear on the original birth certificate. However, once the adoption is finalized:

  • A new birth certificate will be issued that reflects the adoptive parents as the legal parents.

  • The adoptive parents may choose to keep the name you gave, or they may choose a new name for the child.

  • In open adoptions, adoptive families sometimes work together with birth parents to make the naming decision collaboratively.

The final decision on the child’s legal name post-adoption is up to the adoptive parents, unless otherwise agreed upon in a written adoption plan.

Emotional Significance of Naming Your Child

Even if the adoptive family changes the legal name later on, many birth parents find comfort in naming their baby at birth. It can be an important part of:

  • Honoring your child and your role as their birth parent

  • Creating a lasting personal connection

  • Leaving a piece of your love and identity with your baby

Some adoptive families choose to preserve part of the original name —such as the first or middle name—as a way to honor the child’s beginnings.
