Is a court order required for a name change?
Yes, in Louisiana a Judge must approve a name change. The District Attorney is a party to all name changes so that they can confirm to the Court the person has not been convicted of a felony crime of violence, and is not attempting to evade prosecution. As long as the person attempting to change their name does not fall into either of those categories, the Judge will typically approve the name change.
Can I change my name to anything I want?
In theory, yes, you could change your name to anything you would like. However, there is a Court approval process and during that process you must explain to the Judge the reasons you desire to change your name. The reasons are not limited by law, but you must be able to articulate them and make them persuasive to the Judge.
How long does the name change process take?
The length of the process depends, but generally it takes between 3-6 months. The process starts with filing a request with the Court. Once the request is approved by the Court, the proper documents are sent to the Bureau of Vital Statistics. The Bureau will amend the applicant's birth certificate and issue a new one, which generally takes 8-12 weeks.
